Please note: 

This is the award stemming from the Inward Facing Camera (IFC) Dispute on the Union Pacific property involving the installation of IFC's on locomotives. The esteemed Arbitrator Edwin Benn decided the case on that narrow dispute which was "Were the Carriers arbitrary and capricious in their installation of such inward facing cameras on their locomotives?". The answer was No they were not, primarily because the Natrional Transportation Safety Board (NTSB) and FRA were reccomending the installation and such installation was in the interest of employee and public safety. 

The question of the data retireved by such IFC's was left open however, and Arbitrator Benn realized that while his breadth of scope of what he was to decide on was limited, the question regarding the data WOULD come up again at some future date. He offered opinion (non-binding) in how perhaps the Organizations and Carriers should proceed on such an issue which might be helpful in discipline cases involving IFCs in the future.
